By accessing or using Broken Inside (the "Platform"), you acknowledge that you have read, understood, and agree to be bound by these Terms of Use. If you do not agree, please do not access or use the Platform.

Broken Inside is a community-driven platform that facilitates the giving away, swapping, and trading of pre-owned electronics. Important: We do not sell, buy, manufacture, store, inspect, endorse, or take ownership of any items listed. All transactions occur directly between users.

To use the Platform, you must be at least 18 years of age (or the age of legal majority in your jurisdiction), have the legal capacity to enter into a binding agreement, and provide accurate registration information.

You agree to provide accurate information, conduct transactions in good faith, comply with all applicable laws, and treat other users with respect. You agree NOT to list stolen or illegal items, misrepresent item conditions, engage in fraud, harass other users, or use the platform for commercial sales.

All swaps, trades, and giveaways are conducted directly between users. Broken Inside is not a party to any transaction and has no control over the quality, safety, or legality of items. You assume all risk associated with transactions.

THE PLATFORM AND ALL ITEMS ARE PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. We disclaim all warranties including merchantability, fitness for a particular purpose, and non-infringement. Electronic items may be defective, damaged, or non-functional and may pose safety risks.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, Broken Inside shall not be liable for any indirect, incidental, special, consequential, or punitive damages. Our total liability shall not exceed $100 or the amount you paid in the preceding 12 months, whichever is less.

You agree to indemnify and hold harmless Broken Inside from any claims arising from your use of the Platform, violation of these Terms, items you list or exchange, or disputes with other users.

You may terminate your account at any time. We reserve the right to suspend or terminate your access for any reason, including violation of these Terms. Upon termination, provisions that should survive (disclaimers, liability limits, indemnification) shall remain in effect.

These Terms shall be governed by the laws of the State of Delaware, United States. Any legal action shall be brought exclusively in Delaware courts.
